Common questions about multi-residential design and planning in Melbourne

Amendment VC267 introduced the Townhouse and Low-Rise Code in March 2025, creating a deemed-to-comply assessment pathway under Clause 55 for townhouses and apartment buildings up to three storeys. Designs that meet the code remove subjective neighbourhood character assessments, eliminate third-party VCAT appeals and deliver far more predictable approval outcomes.

Faster approvals, reduced objection risk and greater design certainty are the key benefits. The new code also revised minimum setbacks and open space requirements — in many cases making previously marginal sites viable. PD Studio's designs are built around the new code from day one.

A VC267 deemed-to-comply application typically takes 60–90 days from lodgement to permit issue, depending on the council. Non-compliant or discretionary applications take longer — often 4–6 months or more if objections are received.

Under VC267, projects that fully comply with the Townhouse and Low-Rise Code have no third-party VCAT appeal rights — meaning neighbours cannot take your application to tribunal. Council still notifies neighbours in most cases, but objections cannot block a compliant application.

Yield depends on your site's zone, overlay controls, frontage, lot size and the applicable code standards — particularly setbacks, site coverage and private open space requirements. PD Studio offers a free feasibility assessment to tell you exactly what your site can achieve.

In most cases, yes. Two or more dwellings on a lot in a residential zone require a planning permit in Victoria. The process is now faster for VC267-compliant designs, but it is still required.

Clause 55 applies to townhouses and apartments up to three storeys. Clause 57 applies to four-storey apartment buildings, and Clause 58 (Better Apartments Design Standards) applies to five storeys and above, introducing minimum apartment sizes, 2.7m ceiling heights and communal open space requirements.

Yes. Once your planning permit is issued, PD Studio prepares full construction documentation and lodges the building permit application with a registered building surveyor.
