Clause 52.23 Feasibility Assessment

Under Clause 52.23, a rooming house with up to 9 bedrooms, no more than 12 occupants and a gross floor area under 300m² may be exempt from requiring a planning permit, provided zoning conditions are met. We check your site before any design work begins.

Design & Planning Permit

We design an efficient room layout maximising bedroom count within the site's constraints — with compliant shared kitchen, living area and bathroom facilities. Where a planning permit is required, we manage the process through to permit issue or VCAT if needed.

NCC Class 1b Building Permit Documentation

Rooming houses are Class 1b buildings under the NCC, triggering additional requirements including hard-wired interconnected smoke alarms, evacuation lighting and minimum bedroom sizes (12m² for single occupancy stays over 31 days).

Council Registration & CAV Operator Licence

Once construction is complete, the rooming house must be registered with council as prescribed accommodation, and the operator must hold a Rooming House Operators Licence issued by Consumer Affairs Victoria.
